1. Definitions

For purposes of this Limited Warranty and Refund Policy (the “Warranty”):

1.1. “Device” means a new Heatbit-branded electronic heater purchased directly from Heatbit Inc. (“Heatbit”), including all accessories supplied in the original packaging.

1.2. “Customer” means the original end-user purchaser of the Device, and excludes resellers, distributors, agents, or any subsequent purchasers.

1.3. “First Activation” means the initial pairing of the Device with the Heatbit mobile application and binding to the Customer’s personal account.

1.4. “Warranty Period” means twelve (12) months commencing on the date of First Activation, but in no case later than twelve (12) months from the date of shipment of the Device to the Customer, unless extended by additional written warranty terms expressly published by Heatbit at the time of purchase.

1.5. “Valid Claim” means a claim submitted by the Customer during the Warranty Period, supported by proof of purchase, and confirmed by Heatbit to arise from defects in materials or workmanship under normal residential use.

1.6. “Remedy” means the actions described in Section 4 of this Warranty (repair, replacement, or refund, as applicable).

2. Scope and Applicability

2.1. This Warranty applies solely to Devices purchased by Customers as defined above.

2.2. This Warranty is non-transferable and automatically terminates upon any resale, transfer, or assignment of the Device.

2.3. No reseller, distributor, agent, or employee of Heatbit is authorized to modify, extend, or expand the scope of this Warranty.

3. Term of Warranty

3.1. Heatbit warrants that each Device shall be free from defects in materials and workmanship under normal residential use for the Warranty Period.

3.2. The Warranty Period may be extended only if additional written warranty terms are expressly published by Heatbit at the time of purchase.

3. System and Software Support

3.1. Integrated System. Heatbit Devices rely on both hardware and embedded software (firmware). While this Warranty primarily covers hardware defects, Heatbit also provides software and firmware support to maintain Device functionality during the Warranty Period.

3.2. Remote Diagnostics. Before authorizing warranty service, Heatbit may require the Customer to perform reasonable troubleshooting steps with Heatbit Support, including but not limited to:

  a) running diagnostic tests;

  b) applying available software or firmware updates;

  c) performing configuration adjustments or device resets.

3.3. Software Updates. During the Warranty Period, Heatbit will provide, at no additional cost, software and firmware updates necessary to correct defects, address security vulnerabilities, or remedy critical malfunctions that prevent the Device from operating as intended, provided such updates are technically feasible. Heatbit does not warrant that the operation of the Device or software will be uninterrupted or error-free, but will use commercially reasonable efforts to maintain essential functionality.

3A.4. Exclusions. This Warranty does not cover:

  a) issues caused by unauthorized software modifications, rooting, or installation of third-party firmware;

  b) incompatibility with non-Heatbit software, services, or networks;

  c) temporary service outages or disruptions beyond Heatbit’s control.

4. Exclusive Remedies

4.1. If a Valid Claim is received during the Warranty Period, Heatbit shall, taking into account the Customer’s preference but reserving final decision-making authority, and as the Customer’s exclusive remedy, take one of the following actions:

  a) Repair the Device using new or refurbished parts;

  b) Replace the Device with a new or refurbished unit of equal or greater value; or

  c) Refund the original purchase price paid by the Customer, but only if repair or replacement is not reasonably possible.

4.2. Remedies under Section 4.1 shall be carried out within a reasonable period of time, consistent with applicable law.

4.3. The remedies described herein are exclusive. Customer shall not be entitled to any other remedies, whether at law or in equity.

5. Warranty Service Procedure

5.1. To obtain service under this Warranty, the Customer must contact Heatbit at support@heatbit.com for instructions and return authorization in case of required service or return of purchase.

5.2. Devices must, where required, be returned to the service address designated by Heatbit, safely packaged to prevent damage in transit (original packaging preferred but not required), and accompanied by all accessories, parts, and documentation.

5.3. Heatbit will use commercially reasonable efforts to complete repair or replacement within thirty (30) to forty-five (45) days of receipt.

5.4. Heatbit shall bear the cost of return shipping for Devices returned pursuant to an authorized Valid Claim. If, after inspection, the Device is found to be free from defects covered by this Warranty, Heatbit reserves the right to charge or deduct the shipping costs incurred from the Customer.

6. Exclusions and Limitations

6.1. This Warranty does not apply to, and Heatbit shall have no responsibility for:

  a) Devices damaged through misuse, abuse, neglect, accident, improper installation, or unauthorized alteration, modification, or repair;

  b) Damage resulting from external factors, including but not limited to power surges, fire, water, weather events, or other acts of God;

  c) Normal wear and tear, consumables (including but not limited to filters), or cosmetic damage that does not affect functionality;

  d) Any third-party hardware or software, whether or not bundled with the Device.

6.2. Any claims relating to third-party products must be directed exclusively to the applicable manufacturer.

7. Disclaimer of Warranties

7.1. To the maximum extent permitted by applicable law, all implied warranties, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are hereby disclaimed.

7.2. Where such disclaimers are prohibited, implied warranties shall remain in force only for the minimum duration required by law and shall be limited to the Remedies described in Section 4.

7.3. Heatbit does not warrant uninterrupted or error-free operation of any Device.

8. Limitation of Liability

8.1. To the fullest extent permitted by law:

  a) Heatbit shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to loss of profits, loss of data, or loss of use, arising from or relating to any Device.

  b) Heatbit’s total aggregate liability under this Warranty shall in no event exceed the purchase price actually paid by the Customer for the Device giving rise to the claim.

9. Refund Policy

9.1. Warranty Refunds. Refunds shall be available exclusively as provided under Section 4.1(c).

9.2. Pre-Order Refunds. A Customer may cancel a pre-order at any time prior to shipment of the Device and receive a full refund of the purchase price. Once the Device has been shipped, the pre-order is no longer refundable except as otherwise provided under this Warranty or applicable consumer protection law.

9.3. Processing of Refunds. All approved refunds shall be issued to the original payment method. Processing times may vary depending on the payment provider.

9.4. Currency and FX Adjustments. For payments made in currencies other than United States dollars (USD) or in cryptocurrencies, the refund amount shall be calculated based on the USD value at the time of the original transaction.
